The present petition has been filed under Section 438 Cr.P.C. seeking anticipatory bail in connection with FIR No. 744/2023 under Sections 307/34 IPC registered at PS Govindpuri.

The case of the prosecution is that a scuffle between complainant's father and his two neighbours occurred during a marriage function, which was resolved peacefully. On 05.12.2023, co-accused Narendra went to the complainant's house and started breaking the gate of his house with stones and kicks. on his back. This led to the registration of aforesaid FIR. 5.
The learned counsel for the petitioner submits that no overt act has been alleged against the present petitioner. He further submits that the injuries suffered by the petitioner were not grievous and he was discharged on the same day.

On a query posed by the Court, the learned APP, on instructions from the Investigating Officer who is present in Court, affirms the position that the complainant / victim was discharged on the same day. 7.
In view of the above, it is directed that in the event of petitioner being arrested, he be released on bail subject to his furnishing personal bond in the sum of Rs. 10,000/- and a surety bond of the like amount to the satisfaction of the Investigating Officer / Arresting Officer, further subject to the condition that he will join investigation as and when directed by the Investigating Officer concerned.
