This is an appeal filed by the Appellant - Jan Mohammed Sheikh under Section 21(4) of the NIA Act, 2008 read with Section 439 of the CrPC, challenging the impugned order dated 9th January, 2024, in Case No. SC 61/2022 titled "State v. Jan Mohammad Sheikh @ Kaliyaaand Ors". Vide the said impugned order the Appellant has been refused bail. Presently bail is sought for the marriage of the daughter of the Appellant, which is scheduled on 19th January, 2025 in Mumbai.

The matter was listed yesterday i.e., 15th January, 2025 for the first time and notice was issued. Mr. Bahri, ld. APP accepted notice and needed some time for verification of facts and to make submissions on the role of the Appellant in this matter. Today, after some hearing, the Court had suggested to the Appellant that the Appellant could be permitted to attend the Nikah ceremony on 19th January, 2025 in police custody.

However, in view of the personal family circumstances, the Appellant does not wish to press the present appeal and the appeal is accordingly dismissed.
