The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023 seeks direction to the Trial Court to expedite the arguments on the framing of charge in criminal case no. 8835/2022 emanating from FIR No. 129/2022 registered at PS: Special Cell. 2.
Counsel for Petitioner states that the matter was listed for arguments on charge on 31st July, 2024. Since then, the matter was listed on six occasions, however, arguments on charge have not been concluded. In absence of such a decision, Petitioner's right to apply for bail, as noticed in order dated 12th July, 2024 by the Sessions Court, is being impeded. 3.
Counsel for Petitioner very candidly states that the Trial Court hearing the matter is over-burdened with work, nonetheless, he submits that the hearing be expedited.
