% 12.01.2016 Arguments heard.

The present application under Section 438 Cr.P.C. has been filed by the petitioner/accused for the grant of anticipatory bail in FIR No.1156/2015, under Sections 308/341/34 IPC, Police Station Nand Nagri.

The allegations levelled against the accused are that he along with other co-accused persons caught hold of the injured and given beatings to him. It is further alleged that the third accused Rakesh caused injuries on the person of the injured due to which Section 308 IPC has been added in the present case.

It has been submitted by the counsel for the petitioner that the nature of injuries sustained by the injured is simple. Admittedly, no injury has been attributed to the present petitioner/accused. Keeping in view the non-attribution of injury to the petitioner/ accused, it is hereby ordered that in the event of arrest of the petitioner/accused, he shall be released on bail on furnishing the personal bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of the arresting officer. However, the petitioner is directed to join the investigation as and when required. He is directed not to leave the country without prior permission of the Court concerned.

He is further directed not to tamper with the evidence and not to influence the prosecution witnesses. The present application is disposed of accordingly. P.S.TEJI, J JANUARY 12, 2016 dd
