By filing this application under Section 438 Cr.P.C., petitioner is seeking anticipatory bail in case FIR No.663/2014 registered under Sections 147/148/149/323/341/452 IPC at PS Zafrabad.

The FIR has been recorded on the statement of Ravinder Kumar who reported that the initial dispute was between two ladies, one of them was sister-in-law (Bhabhi) of Brij Mohan. Brij Mohan and Vipin @ Laddoo were misbehaving with other lady. The complainant objected to their misbehaviour with the other lady. Brij Mohan and Vipin @ Laddoo started beating him and he ran away from there. In the meantime, when Brij Mohan and Vipin @ Laddoo were chasing the complainant, his brother and friends came there and they gave beatings to Brij Mohan and Vipin @ Laddoo with rods and iron sticks after snatching the same from them. PCR was informed. 3.
During night time at about 9.45 p.m. on the same day, some boys BAIL APPLN. 115/2016
entered into the house of the complainant and started beating him. On hearing his cries, people of the locality gathered there. Some of the boys who allegedly gave beatings to the complainant, were named as Naveen, Ishu, Kale Pahalwan, Lala, Naval, Sanjay and some other person. It is also mentioned in the FIR that the people of localities started pelting stones from their roof top on those boys and in the meantime, the complainant managed to escape from there.

The MLC of the complainant, which was prepared at 3.40 a.m. on 10th September, 2014, was placed on record which shows abrasion over right perennial region and CLW over left leg and nature of injury has been opined as 'simple'.

It is submitted on behalf of the petitioner that cross FIR No.662/2014 under Section/307/323/341 IPC is also registered and co-accused has been granted anticipatory bail.

Taking into consideration the manner in which the occurrence has allegedly taken place as well the nature of the injury recorded in the MLC, I find it to be a fit case to enlarge the Petitioner on anticipatory bail. It is directed that in the event of his arrest he shall be released on bail on his furnishing personal bond in the sum of ` 25,000/- with one surety of the like amount to the satisfaction of concerned IO/SHO. 7.
Petitioner is directed to join the investigation as and when required by the Investigating Officer.
