O R D E R

% 24.01.2020 1.

Mr. Mayank Manish, who appears on behalf of the petitioner, says that the issue which arises in the instant matter stands covered by the judgment of this court dated 19.12.2019 passed in W.P.(C)No.13016/2019, titled : Shri Gajanan Maharaj Shikshan Prasarak Mandal v. National Council For Teacher Education & Anr.

2.

Ms. Arunima Dwivedi, who appears on behalf of the respondents, says that as held by this court, a copy of the show cause notice (SCN) in this case will also be furnished to the petitioner and the Western Regional Committee (WRC) will accord a fresh opportunity to the petitioner. 3.

The substantive prayers made in the writ petition are as follows : "(a) Issue an appropriate writ[s]/direction[s] or order[s] quashing the WRC's order dated 11.10.2019; and W.P.(C) 13922/2019

(b) Issue an appropriate writ[s]/direction[s] or order[s] directing the WRC for reconsidering the case of the Petitioner institution and passing the appropriate orders." 4.

The petitioner's grievance, inter alia, is that the SCN dated 21.02.2017 was not served upon it.

5.

To be noted, via the impugned order, the recognition granted to the petitioner vis-a-vis B.Ed. course was withdrawn. 6.

Accordingly, the impugned order dated 11.10.2019 passed by the WRC is set aside.

7.

The petitioner is granted two weeks to file a reply to the SCN upon a copy of the same being supplied to it by the respondents. The respondents will furnish a copy of the SCN dated 21.02.2017 within one week of receipt of a copy of the order passed today.

8.

The WRC will reconsider the matter after giving due opportunity of hearing to the authorized representative of the petitioner. 9.

The WRC will pass, thereafter, a speaking order; a copy of which will be furnished to the petitioner.

10.

In case, the petitioner is aggrieved with the order passed by the WRC, it will have liberty to assail the same as per law. 11.

The captioned writ petition is disposed of in the aforesaid terms. 12.

Resultantly, the pending application shall stand closed. RAJIV SHAKDHER, J JANUARY 24, 2020 aj W.P.(C) 13922/2019
