The Court on various earlier dates has noted the suppression of the material facts in the part of the petitioner. The petitioner was also directed to remain personally present vide order dated 19.09.2023. Reference can be made to orders dated 22.02.2023, 02.05.2023 and 19.09.2023. 2.
The petitioner is not appearing despite Court directions, and instead, has filed an application seeking permission to withdraw the petition. 3.
The said application is opposed by Mr. T. Singhdev, learned counsel, who contends that heavy costs may be imposed on the petitioner and the liberty to file a fresh petition should not be granted.
