W.P.(CRL) 139/2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks extension of parole granted by the competent authority vide order dated 22.12.2025. 2.
It is noticed that vide his Application dated 27.10.2025, the petitioner had sought parole for a period of 06 months. However, vide order W.P.(CRL) 139/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. dated 22.12.2025, the petitioner was granted parole for a period of 02 weeks. The petitioner is stated to have been released from custody on 09.01.2026.

Learned counsel for the petitioner submits, that the petitioner was granted parole on the ground that the petitioner and his wife were attempting to conceive through In-Vitro Fertilization. Learned counsel submits, that weeks is not long enough to complete treatment/process.

Learned counsel also submits, that the parole granted to the petitioner expires on 23.01.2026.

Since parole was granted by the concerned authority, the petitioner is directed to first send a representation/application to the said authority, seeking extension of parole. The concerned authority is directed to decide such representation/application within 03 days, in accordance with the relevant rules, under written intimation to the petitioner. 6.
The petition is disposed-of in the above terms, granting liberty to the petitioner to approach this court in the event his grievance survives thereafter.
