The present petition has been filed by the Petitioner- Mr. Rahul Bajaj under Articles 226 of the Constitution of India, inter alia, seeking restraint order against the Respondents from interference and harassment of Petitioner in respect of his vending site bearing no. 1512956, near Sector 21, Metro Station Entry Gate, Dwarka-C, Najafgarh Zone, South West Delhi (hereinafter, 'vending site').

The case of the Petitioner is that he has been peacefully vending from the vending site since June, 2023 and is a valid tehbazari receipt holder. He is unnecessarily being harassed by the Respondents with the intent to remove the Petitioner from the vending site. The photographs of the vending site have also been placed on record by the Petitioner. 5.

Ld. Counsel for the Respondent No.1- Municipal Corporation of Delhi (hereinafter, 'MCD') submits that the MCD has repeatedly called upon the Petitioner to furnish the requisite documents, however, the Petitioner has failed to do.

Heard ld. Counsels for the parties. Let the Petitioner appear before the concerned Assistant Commissioner, Najafgarh Zone and submit all the requisite documents.

After perusing the requisite documents and hearing the Petitioner, a reasoned order shall be passed by the concerned Assistant Commissioner, Najafgarh Zone. The same shall be decided within a period of two months. 8.

All rights and remedies of the Petitioner are left open. 9.

The petition is disposed of in these terms. All pending applications, if any, are also disposed of.
