JUDGMENT
BRIJESH SETHI, J (oral) It is submitted by learned counsel for the petitioner that proceedings against the two accused persons namely Mukesh Kumar and Tanvir have been quashed by the Coordinate Bench of this Court i.e. Hon'ble Mr. Justice Vibhu Bakhru, today itself. The petitioner Arun Kumar @ Bittu has filed the present petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing W.P.(Crl.) 3622/2019
of FIR No. 574/2019, under sections 308/341/34 of the Indian Penal Code, 1860 ('IPC'), registered at P.S.: Kalkaji and the proceedings emanating therefrom.
The petitioner and respondent nos.2 and 3 have submitted that they have settled their disputes vide Memorandum of Settlement dated 25.12.2019.
Respondent nos.2 and 3, who are present in Court, have reiterated the aforesaid facts and submitted that they have amicably settled their dispute. Respondent nos.2 and 3 further submitted that they have no objection to the FIR being quashed and the petition being allowed. The Investigating Officer, who is present in Court, has identified the petitioner as well as respondent nos.2 and 3. In view of the above settlement arrived at between the parties, this Court is of the view that no fruitful purpose would be served in keeping the parties entangled in the criminal proceedings. Accordingly, in the interest of justice, FIR No. 574/2019, under sections 308/341/34 of the IPC, registered at P.S.: Kalkaji and the proceedings emanating therefrom are quashed.
