O R D E R

Learned counsel appearing for the respondent/Municipal Corporation of Delhi ("MCD") submits that permanent allotment of booth has been given to the petitioner.

He submits that as far as permanent allotment is concerned, it is the mandate of Town Vending Committee ("TVC") in terms of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014, to make such allotments.

He further submits that the MCD shall not disturb the possession of the petitioner in any manner, and the petitioner can continue operating the PCO booth, as allotted by the MCD.

He further submits that as and when the TVC takes a decision, the allotment of the PCO booth, shall be made in a permanent manner to the petitioner.

However, he submits that even otherwise, the petitioner can continue operation of his booth unhindered.

The MCD is bound by the aforesaid statement.

It is directed that the MCD shall not disturb the possession of the petitioner in any way or create any hindrance to the smooth operation of the PCO booth by the petitioner.

At this stage, learned counsel appearing for the petitioner submits that the petitioner is satisfied by the undertaking of the respondent-MCD. 9.

Accordingly, the present petition, along with the pending applications, is disposed of, in terms of the aforesaid.

However, it is clarified that in case the petitioner is aggrieved by any action of the MCD, the petitioner is at liberty to approach this Court.
