By virtue of the present petition under Article 226 of Constitution of India Constitution read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) as also read with Section 438 of the Code of Criminal Procedure, 1973 (Cr.P.C), the petitioner seeks grant of parole for a period of eight weeks.

Learned ASC for the State has handed over a copy of the order dated 09.01.2026 passed by the learned Deputy Secretary, GNCTD, Home Department, wherein, the earlier application of the very same petitioner has been rejected. The same is taken on record. 3.

In view thereof, learned counsel for the petitioner appearing through video conferencing, seeks leave to withdraw the present petition with liberty to move an appropriate petition qua the same.
