% 04.08.2017 Respondent has been served through publication, however, none has appeared on behalf of the respondent. Respondent is proceeded ex parte. The present petition is filed under section 11(6) of the Arbitration and Conciliation Act, 1996 seeking to appoint an Arbitrator to adjudicate the dispute between the parties. On 6.6.2013 a License and Service Agreement was executed between the parties which was effective from 1.6.2013 for a period of three years. The agreement sought to implement and market the courses offered by the petitioner. The petitioner claims that the respondent is liable to pay a sum of Rs.13,45,722/- as on 30.11.2014. The License and Service Agreement dated 6.6.2013 has an arbitration clause. Clause 20.3 provides that in case dispute arises between the parties, the parties undertake to settle the same through mutual negotiations and in case no settlement is
arrived at the matter shall be referred to the sole Arbitrator, Keeping in view the above Mr. B.C. Pandey, Advocate (Mob. 9811007851) is appointed as the Sole Arbitrator to adjudicate the dispute between the parties. The learned Arbitrator will act under the aegis of the Delhi International Arbitration Centre.
