Heard the Petitioners in person, Mr. Kush Sharma representing the Delhi Pollution Control Committee-Respondent No. 3 and Mr. Dhruv Rohtagi representing the District Magistrate-Respondent No. 5. 2.

By instituting the proceedings of this Public Interest Litigation Petition, certain concerns have been expressed in relation to likelihood of causing damage to the air quality and impacting the air and noise pollutions on account of an event, 'BURNOUT CITY' ("Event"), which is scheduled to be organized on 17.01.2026 at National Small Industries Corporation The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The submission made on behalf of the Petitioners is that the kind of activities which are scheduled to take place in the Event are such that they will have adverse impact on the environmental situation, especially on the air quality, which may ultimately be against the Graded Response Action Plan, which is imposed by the Commission for the Air Quality Management in National Capital Region and Adjoining Areas. 4.

It is also the submission of the learned Counsel for the Petitioners that more consumption of the vehicle fuels such as petrol and diesel is also likely to worsen the air quality of the nearby areas. 5.

The Writ Petition, in our opinion, does not contain the necessary data or information on the basis of which the Court can come to a conclusion that the scheduled Event is likely to impact the air quality or cause any other pollution like noise pollution.

The Petitioner has already represented his cause to various authorities including the District Magistrate, Sout East District, New Delhi as is apparent from Annexure-P/2 appended with the Writ Petition. 7.

Accordingly, without entering into the merits of the claim of the Petitioners, we require that the District Magistrate concerned to look into the grievances raised in this Petition, especially those mentioned in the representation dated 04.01.2026 as enclosed with the Writ Petition at Page No. 37 and take appropriate decision, which may be warranted under law. 8.

Having regard to the fact that the Event is scheduled to be held on 17.01.2026, the District Magistrate is expected to take into account the grievances raised by the Petitioners at the earliest. 9.
