The present writ petition has been filed challenging the tender dated 08th January, 2024 issued by the respondent for the widening of road of Khammkam-Kurvi Section of NH365A in the State of Telangana. The grievance of the petitioner is that vide letter dated 08th January, 2024 the bid submitted by the petitioner was rejected with remarks "Technically NonResponsive as per clause 2.2.2.1 of RFP". 2.
Learned counsel for the respondent states that the petitioner's representation was rejected by the Evaluation Committee on 16th January, 2024. He states that thereafter the Financial Bids were opened and the L-1 bidder has been declared. Learned counsel for the petitioner admits that the petitioner's bid was higher than the L-1's bid. In view of the aforesaid, the present writ petition and applications are disposed of as infructuous. However, issue of law raised in the present petition is left open.
