The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a direction in the nature of Habeas Corpus, directing the respondents to produce the wife of the petitioner, namely, Ms.Laxmi, who is stated to be in illegal and unlawful confinement of respondent no.4 and other family members. 2.

Ms.Laxmi, who is a major, has been produced in the Court. She states that she has legally married the petitioner and the said fact has also been verified by the police.

She further states that she wishes to go with the petitioner. 4.

We must herein note that this is the second round of litigation. Earlier as well, the father of the girl had filed a writ petition being WP(Crl.) 2193/2017, titled Puttu Singh v. State of NCT of Delhi & Ors., wherein, vide order dated 16.08.2017, the factum of marriage of the girl with the petitioner was verified and, after speaking with the girl, her The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. parents, and parents of the petitioner herein, it was directed that the girl is at liberty to go with the petitioner and the SHO of the concerned Police Station was directed to provide them with his telephone number and that of a lady police officer, so as to enable the girl to contact them in the event of any threat or apprehension to her safety and security. 5.

What has been stated to us thereafter is more shocking. In spite of the above order, the petitioner himself states that the girl did not stay with him and went away with her parents voluntarily. Thereafter, the girl married with one Dalip on 10.03.2018, and states that within one month thereof, she left her matrimonial home. She has also lodged an FIR, being FIR No.371/2024 dated 15.11.2024 under Section 498A/406/34 of the Indian Penal Code, 1860, Police Station: Karawal Nagar, Delhi, against the second husband and his parents.

Be that as it may, as the girl is major and today wishes to go along with the petitioner, we direct that she be allowed to go along with the petitioner. The SHO of the concerned Police Station shall give the number of the Beat Constable to the petitioner and the girl. They shall be at liberty to contact the Beat Constable in case of any threat perception. 7.
