The petitioner has filed the present petition impugning an order dated 05.11.2019, whereby his application for furlough was rejected on the ground that the petitioner had not completed one year of custody as a convict after he was arrested on 01.02.2019.

The nominal roll indicates that the appellant was released on 19.02.2008 and was re-arrested on 01.02.2019 and thus, he had not completed one year in jail after his arrest.

Admittedly, the petitioner has now completed the one-year period. The concerned authorities are directed to re-examine the appellant's application and consider his application treating the same as having been filed as on date. The concerned authority shall communicate its decision as expeditiously as possible and, preferably, within a period of four weeks from

today.
