By virtue of the present petitions under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioners seek quashing of Complaint Case No.1537/2023 entitled 'Registrar of Companies vs. Anita Garg & Ors.' filed by the respondent before the learned Additional Chief Judicial Magistrate (Special Acts), Central District, Tis Hazari Courts, New Delhi (learned ACJM) and all proceedings emanating therefrom including the summoning order dated 09.06.2025 passed by the learned ACJM.

Notice is accepted by the learned counsel appearing for the respondent.

Considering that though the application under Section 473 of Code of Criminal Procedure (CrPC) for condonation of delay of 1 year, 7 months and 22 days was filed by the respondent/ complainant alongwith the complaint under section 129(7) read with SCHEDULE III of the Companies Act, 2013, nevertheless learned ACJM while passing the impugned order has neither issued notice, nor adjudicated upon the same, the impugned summoning order dated 09.06.2025 is set aside. As such, the learned ACJM is directed to hear the parties upon the same for first adjudicating upon the same.

Accordingly, the present petition is disposed of in the aforesaid terms.
