The petitioner was granted permission to travel to London, United Kingdom by the learned Trial Court by order dated 03.09.2022, noting that the petitioner had already been admitted on bail and that his wife was alone and had to undergo a cataract surgery. The learned Trial Court further noted that the petitioner has no offsprings and is also an overseas citizen of India with British Citizenship. The rejection of extension to stay in United Kingdom by the impugned order dated 13.01.2023 led to the filing of the present petition.

This Court, by order dated 17.01.2023, had extended the petitioner's stay in United Kingdom noting that the petitioner is a 76 years old overseas citizen of India and has been a resident in London for the past 53 years.

It is pointed out that the investigation is already complete in the present matter and the learned Trial Court has listed the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. matter for further proceedings on 03.02.2026. The petitioner thus is not required to appear before the learned Trial Court on any date prior to 03.02.2026.

Considering the above, the present petition is allowed and the petitioner is permitted to stay in United Kingdom till such time he is not required to appear in person before the learned Trial Court.

Needless to say, the petitioner is at liberty to file an appropriate application before the learned Trial Court seeking exemption from personal appearance and avail any other remedy as is available in law. As and when such an application is filed, the same is directed to be considered on its own merits. 6.

The petition stands disposed of with the aforesaid observations.
