O R D E R

The petitioner has filed the present petition, inter alia, seeking anticipatory bail in connection with FIR No. 29/2017 under Section 306 of the IPC registered with PS Shahbad Dairy.

The said FIR was registered at the instance of the father of the deceased.

He had alleged that on 17.09.2019 his son, Deepak Jha (since deceased), was filling water from a tanker and he accidentally struck the petitioner. The petitioner, who is a woman aged sixty-three years, her two sons and her daughter (Sunil, Basant and Kavita respectively) started beating the deceased. He stated that on 17.09.2016, he found his son Deepak was looking worried and when he got up next morning, that is, on 18.09.2016 Deepak was not at home. On the same day, he found a letter on the fridge written by Deepak, which stated that he was ending his life and the

petitioner was blamed for the same. Subsequently, on 20.09.2016, the police officials found the body of the deceased. The status report indicates that the handwriting on the suicide note has been examined and according to the FSL report, the same is in the handwriting of the deceased. 3.

Admittedly, the petitioner has joined the investigation. Considering the facts and circumstances of this case and the fact that apart from the suicide note, there does not appear to be any direct involvement of the petitioner, this Court considers it apposite to allow the present petition. 4.

The petitioner is granted anticipatory bail on her furnishing a personal bond in the sum of ₹10,000/- with two sureties of the equivalent amount to the satisfaction of the concerned IO/SHO. The petitioner shall continue to cooperate with the Investigating Officer. She shall provide her mobile number to the IO and ensure that she is reachable at all times. 5.
