The petitioners seek quashing of FIR No.462/2016 under Sections 498A/406/34 IPC and Section 4 of the Delhi Police Act, Police Station Khajuri Khas, Delhi.

Petitioner No.1 is the husband of respondent No.2. Petitioner Nos.2 & 3 are the parents of petitioner No.1. Petitioner Nos.4 & 5 are the brother and sister-in-law of petitioner No.1.

Petitioner No.6 is the sister of petitioner No.1.

On account o0066 matrimonial discord, the subject FIR was lodged by Respondent No. 2.

It is contended that the parties have settled their disputes. Crl.M.C.32/2018

Settlement Deed has been recorded in Maintenance Petition bearing CC No.483/2015, wherein the parties have amicably resolved to cohabit together.

It is contended that respondent No.2 has started living with petitioner No.1. Respondent No.2 is present in Court and is identified by her counsel as well as the Investigating Officer. She submits that she has amicably resolved her disputes and is happily living with petitioner No.1. She submits that she does not wish to press the present petition any further. 6.

In view of the fact that the FIR emanates from matrimonial discord and the parties have resolved their disputes and are living together happily, there would be no purpose in continuing with the prosecution. Petitioner No.1 and respondent No.2 submit that the said FIR be quashed. It would also be expedient and in the interest of justice, that the FIR and the consequent proceedings emanating therefrom by quashed. 7.

In view of the above, the petition is allowed. FIR No.462/2016 under Sections 498A/406/34 IPC, Police Station Khajuri Khas, Delhi, and the consequent proceedings arising therefrom are hereby quashed. 8.
