Bail Appln.3011/2019 Vide the present petition, the petitioner seeks direction thereby to direct the applicant/ petitioner be released on bail by the SHO/ Investigating Officer/ Arresting Officer concerned in the event of his arrest in FIR No. 263/2019 u/s 376 IPC r/w Section 4 of the POCSO Act registered at Police Station Malviya Nagar.

Keeping in view the serious allegations of rape made by the prosecutrix, who is just 14 years of age, I am not inclined to grant anticipatory bail to the petitioner.

Moreover, to get the information regarding SMS, messages and other notes, custodial interrogation is required.

Accordingly, the petition is dismissed.
