% 16.09.2016 I.A. No.11344/2016 (u/o XXIII R.3 CPC) & O.M.P. No.35/2014 The abovementioned application has been filed by the petitioners under Order XXIII Rule 3 CPC.

It is stated in the application that during the pendency of the present petition, the petitioner No.1 and the respondent have mutually settled their disputes, in terms of the Memorandum of Settlement (MoS) dated 25th July, 2016. The terms and conditions of the settlement are mentioned in the said MoS. Copy of the said MoS has been filed along with the application which is duly signed by the parties. In support, the affidavits of the parties have also been filed. The parties shall be bound by the terms and conditions of the settlement.

In view of the settlement, the petition filed by the petitioners is disposed of.

I.A. No.11344/2016 also stands disposed of.
