Allowed, subject to all just exception. Application is disposed of. CM(M) 120/2026, CM APPL. 2960/2026 (for Stay) & CM APPL. 2962/2026 (for Direction) 3.

The present petition has been filed by the petitioner under Article 227 of the Constitution of India, 1950 assailing the impugned order dated 23rd December, 2025 passed by the trial court in case bearing no. MCD Appeal No. 3/2025, whereby the interim relief sought by the petitioner has been declined.

Ld. Counsel on behalf of respondent no. 1 appeared on advance notice and accepts notice.

The impugned order dated 23rd December, 2025, is reproduced as follows:

Ld. Counsel for respondent nos. 2, 3, 7, 8, 10 and 11 files vakalatnama. Same be also taken on record. Since notice qua Respondent no.4 and 9 returned with the report that they have already sold the house, they are not residing at the given address.

Appellant is directed to furnish the fresh address of Respondent nos. 4 and 9 within the ten days and thereafter notice be issued to them on filing of PF/RC and Speed Post. Arguments heard on the interim relief.

After going through the record and impugned order, I am of the view that it is not a fit case to grant interim relief at this stage.

Let reply, if any, be filed within four weeks with advance copy to the other side.

Renotify the matter on 09.02.2026."

The matter is already fixed for 09th February, 2026 before the trial court for filing of reply by the respondents who has appeared and for the service of remaining respondents. The issue as to whether the petitioner is entitled to interim relief shall be considered thereafter by the trial court. At this stage, this Court do not find any infirmity in the impugned order and the petition stands disposed of accordingly. Pending application(s), if any, also stands disposed of.
