% 06.01.2016 Present writ petition has been filed seeking a direction to respondents to consider the petitioner‟s representations dated 7th April and 18th May, 2015 regarding excess water bill and replacement of old meter having K. No. 2076531000 with new electronic meter.

Learned counsel for the petitioner states that petitioner‟s house was vacant since January, 2013 except for a brief period of six months as the petitioner is residing and practicing his medical profession in Punjab. Learned counsel for the petitioner states that residence in question is being looked after by a caretaker and no commercial activities are being undertaken in the residence.

Learned counsel for the respondents disputes the aforesaid contention. However, he states that he has no objection if petitioner‟s representations are forwarded to Director (Revenue), Delhi Jal Board for adjudication. Consequently, the petitioner‟s representations dated 7th April and 18th May, 2015 are forwarded to the Director (Revenue), Delhi Jal Board for adjudication. Petitioner and a representative of the Delhi Jal Board shall appear before the Director (Revenue) on 18th January, 2016 at 3.00 p.m. The Director (Revenue) is directed to decide the aforesaid representations after giving an opportunity of hearing to both the parties. A reasoned order shall be communicated to the petitioner within eight weeks. Till the petitioner‟s representations are adjudicated upon by the Director (Revenue), this Court directs the petitioner to deposit Rs. 20,000/- with the Delhi Jal Board within a period of two weeks. It is clarified that the aforesaid deposit is without prejudice to rights and contentions of the parties.

With the aforesaid observations, present writ petition and application stand disposed of.
