This application has been filed jointly on behalf of the petitioner and respondent no.3, seeking to withdraw the present writ petition as the matter has been settled between the petitioner and respondent no.3. 2.

In view thereof, the present writ petition is dismissed as withdrawn. 3.

Needless to state, the aforesaid settlement between the petitioner and respondent no.3 shall not bind the respondent-MCD, who shall continue to proceed in accordance with law.

All rights and contentions of the parties qua MCD shall also remain open.
