By way of the present petition under Article 226 of the Constitution, the petitioner seeks a direction for registration of an FIR and investigation into her complaint dated 27.09.2025, submitted at Police Station Anand Vihar, wherein certain allegations have been made against her husband and his family members. The petitioner also seeks a direction to the police authorities to ensure protection to the petitioner and her son, in view of the allegation that threats have been extended by the husband W.P.(CRL) 151/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Mr. Braham Singh, learned counsel for the petitioner, submits that the petitioner has already approached the jurisdictional Magistrate's court under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking registration of an FIR on the basis of the very same complaint. He further submits that the said proceedings are presently pending. In these circumstances, I am of the view that there is no occasion for this Court to exercise its extraordinary jurisdiction at this stage, as the petitioner has already availed of the statutory remedy available to her. 3.

Insofar as the allegation of threats to the petitioner is concerned, Mr. Sanjeev Bhandari, learned Additional Standing Counsel for the State, who appears on advance notice, submits that the telephone numbers of the Station House Officer, Police Station Farsh Bazar, within whose jurisdiction the petitioner resides, as well as that of the concerned beat constable, have been provided to the petitioner. It is stated that she may contact the said officials in the event of any exigency. 4.

In view of the above, the writ petition is disposed of with the aforesaid directions.

It is clarified that this Court has not examined the merits of the allegations raised in the complaint. It is also noted that the husband and his family members have not been impleaded as parties to the present petition. The present order shall, therefore, not be construed as an expression of opinion on the merits of the matter.
