The instant writ petition under Articles 226 and 227 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 has been preferred by the petitioner seeking issuance of a writ of Habeas Corpus directing the respondents to trace and produce before this Court the daughter of the petitioner, who has allegedly gone missing since 2nd January, 2025.

The brief facts that led to the filing of the present petition are: a. According to the petitioner, the missing person herein was pursuing a Nursing Course from NIILM University, Kaithal and was residing with her in Delhi.

b. On 2nd January, 2025, at around 3 PM, the missing person allegedly left home on the pretext of meeting her friend Ms. Alwina, who resides in the same locality; but did not return home thereafter. c. The petitioner attempted to contact the missing person through mobile as well as WhatsApp, but she did not respond to the same. d. After searching in the neighborhood, and asking relatives and the educational institute she was attending, with no fruitful outcome, the petitioner lodged a missing person complaint at Police Station - New Usmanpur on 3rd January, 2025. The said complaint was recorded as G.D. No. 0067A.
e. According to the petitioner, the police have failed to conduct any meaningful investigation. No enquiry was conducted with Ms. Alwina, who, according to the petitioner, may be withholding material from enquiry.
f. Aggrieved by the alleged inaction of the police, the petitioner has filed the instant petition.

Vide order dated 16th January, 2025, the Predecessor Bench of this Court had directed that diligent steps be taken by the respondents in producing the missing daughter before this Court. 4.
Pursuant to the last order, the missing person-Khushi, who is major has been produced before this Court.

Learned counsel for the petitioner submits that consequent to the recovery of the missing person, no further adjudication is required in the present writ. He prayed that this Court may grant him liberty to withdraw the instant petition.

Accordingly, leave is granted as prayed for, and the instant writ petition is dismissed as withdrawn.
