By way of the present writ petition, the petitioners who claim to be the members of the petitioner no.1, i.e. Karawal Nagar Road Welfare Association have approached the Court seeking to restrain respondents from demolishing the properties of the petitioners and dispossessing them from the said properties in the garb of removal of alleged encroachment or road widening exercise along the Karawal Nagar Road to Shiv Vihar Tiraha without following due process of law.

the shops in the said area, details of which are as follows:- i.

Order dated 3rd July, 2006 in W.P.(C) 10477/2006. ii.

Order dated 16th March, 2009 in W.P.(C) 1094/2006. iii.

Order dated 8th January, 2020 in W.P.(C) 137/2020. iv.

Order dated 31st August, 2022 in W.P.(C) 12590/2022. 3.

In the last order passed on 31st August 2022, in W.P.(C) 12590/2022, this Court had disposed of the writ petition on the basis of the statement made by counsel for the MCD that if any demolition action is carried out, the same would be preceded by a show cause notice to the petitioners. 4.

Counsel appearing on behalf of the respondent no.1/MCD appearing on advance notice submits that at this stage, no anti-encroachment drive has been contemplated in the said area. In the event the respondent/MCD were to initiate an anti-encroachment drive, they would give a show cause notice to the petitioner and would act in accordance with the law. 5.

In view of the aforesaid statement, the present writ petition is disposed of.
