Plaintiff and Defendant No. 1 jointly pray for a compromise decree under Order XXIII Rule 3 r/w Section 151 of the Code of Civil Procedure, 1908, on terms enumerated in paragraph No. 4 of the application. 2.
The application is duly supported by affidavits of Authorized Representatives of Plaintiff and Defendant No. 1. Counsel for the parties mentioned in the appearance above, confirm the compromise, identify the signatures of their respective client, and pray that the suit be decreed as per terms mentioned in paragraph No. 4 of the application. 3.
The Court has perused the terms of the compromise and finds the same to be lawful.

Accordingly, the present suit is decreed in favour of Plaintiff and against Defendant No. 1, in terms of compromise recorded in paragraph No. 4 of the application, which shall form part of the decree. 5.
The parties shall remain bound by the terms and conditions of the compromise as recorded in the application.

The suit is decreed in the above terms. Decree sheet be drawn up. 7.
Counsel for Plaintiff, on instructions, states that they do not wish to continue the present suit against Defendant No. 2, who is a proforma party. 8.
In view of the above, the suit, along with pending application, is disposed of.

In view of the fact that parties have arrived at a compromise, Registry is directed to issue a certificate for refund of full court fee, in favour of the Plaintiff.
