Petitioner impugns the action of the respondents in proceeding further with the demand-cum-show cause notice dated 18.05.2007 on the ground that the same is barred by limitation in view of Section 28

(9) (b) of the Customs Act, 1962.

Learned counsel for the respondents submits that pending the subject petition, the show cause notice has already been adjudicated and order-in-original dated 06.02.2024 has been passed. 3.

Learned counsel for the petitioner submits that though respondents could not have adjudicated the show cause notice dated 18.05.2007, however, order-in-original dated 06.02.2024 has been W.P.(C) 615/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. passed in favour of the petitioner. Accordingly, petitioner does not wish to press the petition any further and seeks leave to withdraw the petition.
