In the written submissions, learned Counsel for the Petitioner had taken a point that the order directing the Petitioner to cease the operations of the eating house is unsigned. He has placed reliance on Ramani Suchit Malushte v. Union of India & Ors., 2022 SCC OnLine Bom 11856, M/s SRK Enterprises v. Assistant Commissioner, WRIT PETITION NO. 29397/2023 and a Division Bench Judgment of this Court in Marg ERP Limited through its Auth. Representative Mr. Mahender Singh v. Confronted with this, learned Counsel for the Respondent, states that he has instructions that a fresh signed order will be issued in accordance with law. Till the order signed by the competent authority is not supplied to the Petitioner, the impugned order cannot exist and the Petitioner can operate his eating house.
