After arguments, this appeal is disposed of as not pressed and which appeal impugns the judgment of the trial court decreeing the suit under Order 12 Rule 6 of Code of Civil Procedure, 1908 (CPC), inasmuch as relationship of landlord and tenant is admitted, rate of rent above Rs.3,500/-
per month is admitted taking the premises outside the protection of the Delhi Rent Control Act, 1958 and finally that filing of the suit itself amounts to notice of termination of tenancy.
Withdrawal is allowed however and as agreed subject to the appellants depositing a sum of Rs.10,000/- as costs with the website www.bharatkeveer.gov.in positively within two weeks from today, failing which the costs will become Rs.25,000/-. In case, receipt of costs is not filed in this Court within four weeks, Registry will list the matter in the Court for taking appropriate action against the appellants. 3.
Appeal is accordingly disposed of in terms of aforesaid observations.
