The Petitioner has approached this Court challenging the Order dated 26.12.2023 passed by the Appellate Authority refusing to extend the time granted to the Petitioner to vacate the premises. 2.
The Respondent No.2 had approached the Appellate Authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, for evicting the Petitioner and her husband under Rule 22 of the Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, 2009. 3.
It is stated that the Appellate Authority vide Order dated 11.12.2023 had granted the Petitioner time till 18.01.2024 to complete the construction of the house in which the Petitioner intends to reside with her husband. It is stated that in view of the restrictions imposed by the Government on the construction activities, the Petitioner could not complete the construction within the time period stipulated by the Appellate Authority. she will vacate the premises on or before 11.04.2024. 4.
This has been objected by learned Counsel for the Respondents stating that Respondent No.2 is an 85 year old lady and that she is being harassed constantly by the Petitioner.

In view of the fact that since the Government had imposed restrictions on the construction activities, this Court is inclined to accede to the request made by the Petitioner and extend the time to vacate the premises by 10.04.2024. It is made clear that no further extension of time shall be granted to the Petitioner.
