This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "A. Issue a writ in the nature of mandamus directing the Respondent No.1 & 2 to change the Date of Birth of Petitioner from 28.09.2007 to 28.09.2006 in Class X and XII Mark sheets/ Certificates and other relevant documents as per the original Birth Certificate.

B. Issue a writ in the nature of mandamus directing the Respondent No.3 to renew the passport of the Petitioner as per law."

The case of the petitioner is that the petitioner was born on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

28.09.2006 and birth certificate bearing Registration No. 2305744 was issued by the Local Registrar Births and Deaths, Govt. of NCT of Delhi, which shows petitioner's Date of Birth ("DoB") as 28.09.2006. Even the renewed Passport of the petitioner bearing No. V7600902, issued on 17.03.2022, also shows petitioner's DoB as 28.09.2006. 3.

The petitioner took admission in Sachdeva Public School i.e. respondent No. 2, affiliated with CBSE and appeared for his Class X examination in 2022 and Class XII examination in 2024. However, due to an inadvertent error, his DoB was incorrectly recorded as 28.09.2007 in the school records and hence, subsequently in Class X and XII certificates. 4.

The petitioner has made requests to the respondents to modify the CBSE records and school records to reflect the correct DoB as 28.09.2006. However, no action has been taken.

Hence, the present petition.

Mr. Khanna, learned standing counsel for respondent No.1/CBSE, has vehemently argued the matter and opposes the present petition. 7.

I have learned counsels for the parties.

I am unable to agree with the contentions of the respondent No.1/CBSE.

Firstly, Annexure-P1 (annexed with the petition), which is the Birth Certificate of the petitioner shows the date of birth of the petitioner as 28.09.2006. Further, the petitioner's updated Aadhaar Card (Annexure-P2, annexed with the counter rejoinder on behalf of the petitioner) as well as the Passport (Annexure-P3, annexed with petitioner), both government documents, show the date of birth as 28.09.2006. 10.

Further, this Court in its earlier Order dated 11.02.2026 passed in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Smt. Nisha Ray v. Central Board of Secondary Education & Anr., W.P.(C) 6554/2023, while relying on Jigya Yadav v. CBSE, (2021) 7 SCC 535 and Central Board of Secondary Education v. Prema Evelyn D Cruz and Anr., LPA 171/2023, made the following observations:- "11. Even in the judgement of Jigya Yadav (supra), the Hon'ble Supreme Court has stated that there can only be one Date of Birth. The petitioner is and should be entitled to make a correction to make the document consistent with all public documents, namely, Adhaar Card, PAN Card and the Birth Certificate.

12. In case the petition is not allowed, the petitioner would be having 2 date of births, one shown in the Adhaar Card, PAN Card and Registration Certificate and the other in the Matriculation Certificate which is impermissible and contrary to law."

In view of the above, the present petition is allowed and the DoB of the petitioner shall be corrected and record as 28.09.2006 in the CBSE records and school records, within 2 weeks from today. 12.
