1. This is an application filed by the respondents seeking condonation of 55 days' delay in filing counter affidavit.

2. The application is, for the reasons stated therein, allowed.

Consequently, the delay of 55 days in filing the counter affidavit stands condoned and the counter affidavit filed along with the application is taken on record.

3. The application stands disposed of.

Learned counsel for the petitioner submits that in view of the stand taken by the respondents in paragraph nos.16 & 17 of their counter affidavit, nothing further survives for adjudication in the present petition. expedite release of the amount which is payable to the petitioner as per the decision of the respondents conveyed vide letter dated 20.01.2024 ((Annexure R/18 to the writ petition) and 18.01.2024 (Annexure R/19 to the writ petition) as stated in paragraph nos.16 & 17 of their counter affidavit.

5. Learned counsel for the respondents has no objection to this limited request.

6. In the light of the aforesaid stand taken by the parties, we dispose of the writ petition by directing the respondent to ensure that necessary action in terms of letters dated 20.01.2024 and 18.01.2024 (Annexure R/18 and R/19 to the counter affidavit) is taken within three months and payments in terms thereof is released to the petitioner within the same timeline.

7. Needless to state, in case, the petitioner is aggrieved by any decision taken by the respondents, it will be open for him to seek legal recourse as permissible in law.
