Present application has been filed by applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail in case FIR No. 94/2018 PS Katju Marg under Section 302/34 IPC. 2.

The Applicant is facing trial for murder and is in judicial custody since the date of his arrest i.e. 22.02.2025.

The charge sheet has been filed but the charges are yet to be ascertained.

The bail is being sought for the reasons that the accused had voluntarily, surrendered before the Learned Trial Court. 5.

The FIR in hand is the year of 2018 and, while the other four accused persons, who were arrested and faced trial, have, eventually, been convicted for murder in question.

along with them.

Now after his surrender, a supplementary chargesheet has already been filed.

The applicant himself is responsible for his miseries as, initially, after the registration of FIR, he absconded and was even declared a proclaimed offender by the Court.

The next date before the learned Trial Court is stated to be 09.02.2026. 10.

Keeping in mind the overall facts and, particularly, appreciating the fact that co-accused persons have already been held guilty and the applicant had earlier absconded, this Court does not find any reason to enlarge him on bail, at this juncture.

The application is, accordingly, dismissed.

Learned Trial Court is, however, requested to expedite the trial. 13.

Needless to say, applicant shall render his due assistance and co-operation and would not seek unnecessary adjournment(s).
