% 01.04.2019 CAV 74/2019 Counsel as above appears for the respondent/caveator. The caveat is discharged.

RC.REV. 42/2019, CM APPL No.3456/2019, 3458/2019 Learned counsel for the petitioner submits the petitioner do not intend to challenge the impugned order on merits provided the petitioner is granted some time to vacate the premises. As agreed the petitioner shall now vacate the premises on or before 31st December, 2020 and handover vacant and peaceful possession to the respondent provided the petitioner pays to the respondent an amount of 8,000/- per month w.e.f. 1st April, 2019 as user and occupation charges till vacation of the premises. Future payment be made on or before 7th of

each calendar month. The water and electricity charges be paid as per actuals. The usual undertaking to this effect shall be filed by the petitioner within four weeks from today. Any default in the payment of user/occupation charges shall entail eviction forthwith. The petition along with pending application stands disposed of in terms of above.
