Petitioner impugns judgment dated 23.07.2018, whereby, an order of eviction has been passed against the petitioner in respect of premises bearing No.3538, Ground Floor, Gal Hakim Baqa, Chawri Bazar, Hauz Qazi, Delhi as shown in red colour in the site plan annexed with the eviction petition. The leave to defend filed by the petitioner was refused and consequently, eviction order passed. 2.
Parties were referred to Delhi High Court Mediation & Conciliation Centre.
Parties have entered into the settlement agreement dated 26.08.2019, whereby, the petitioner has undertaken to vacate the tenanted premises and handover the peaceful vacant possession on or before 25.01.2020. Petitioner has undertaken to pay the electricity and water charges and other dues in respect of the RC.REV. 46/2019
tenanted premises upto 25.01.2020. The entire arrears of rent as also the use and occupation charges from the date of the eviction order till 25.01.2020 have already been settled between the parties. 3.
Petitioner has filed an affidavit of undertaking. The same is taken on record. The undertaking is accepted. 4.
Learned counsel for the petitioner prays for leave to withdraw the petition.

Petition is, accordingly, dismissed as withdrawn. 6.
In view of the settlement between the parties, the impugned order dated 23.07.2018 shall not be executed till 25.01.2020. 7.
