Mr. Nalin Kohli, learned senior counsel appearing for the petitioner realises that in view of the facts and circumstances, the petitioner would have to approach the jurisdictional High Court, and, therefore, he seeks liberty to withdraw the instant petition.

He, however, submits that the impugned decision has wider ramifications including empowering the respondent authorities to initiate criminal prosecution against the petitioner. He, therefore, submits that by the time he would approach the jurisdictional High Court and his matter is taken up for consideration, the rights and interest of the petitioner be protected.

He submits that the petitioner will not claim any equity on the basis of such protection as and when his matter is taken up by the jurisdictional High Court.

Mr. Kohli further submits that copy of the petition has duly been served upon all the respondents, and he has placed proof of service on record. However, except respondent- Union of India, no one appears. 5.
Under the peculiar circumstances and looking at the background of the petitioner, the Court deems it appropriate to observe that, in the meantime, no precipitative steps shall be taken against the petitioner till the petitioner's petition is taken up for consideration by the jurisdictional High Court, subject to the petitioner approaching the same within 4 working days from today.

Leaving all rights and contentions open and with the liberty as sought for, the petition, along with pending application, stands dismissed as withdrawn.
