The present petition has been filed impugning the order dated 04.12.2023 passed by learned Additional District Judge-04, Patiala House Court, New Delhi in CS DJ No. 509/2022 titled as "Sartaj Singh & Anr. vs. Vinod Kapoor" whereby the application moved on behalf of the respondent under Order XV-A of Code of Civil Procedure was allowed. After addressing some arguments and on taking instructions from the petitioner, it is submitted by the learned counsel for the petitioner that the petitioner shall deposit a sum of Rs. 5,00,000/- before the learned Trial Court within a week from today and as far as other grounds are concerned, the petitioner shall address the same before the learned Trial Court. 4.
In case, the amount of Rs. 5,00,000/- is not deposited within a week the consequences as per the impugned order shall follow. 5.
In view of the above, the learned counsel for the petitioner seeks permission to withdraw the present petition.

Accordingly, the present petition along with the pending applications are disposed of.
