The petitioner is defendant before the learned Trial Court and, as per the averments made in the petition, is aggrieved by order of the Trial Court whereby his application moved under Order VII Rule 11 CPC has been kept in abeyance and the parties have directed to lead evidence. 2.
Fact remains that when the matter was taken up for the first time on 18.01.2024, there was no appearance from the side of the petitioner, and thereafter, also nobody appeared on 28.08.2024 and 09.01.2025. 3.
Situation is precisely the same, even today.

It seems that petitioner has lost interest in pursuing the present petition. 5.
