Pursuant to the order passed by this Court on 20th January, 2025, counsel for the defendant has obtained instructions. As per instructions received, the defendant is agreeable to file an undertaking to the effect that it shall not issue, publish or circulate any advertisements or videos comparing its products, directly or indirectly, with the products of the plaintiffs. 2.
The present suit is decreed based on the aforesaid statement and without expressing any view on the merits of the case. 3.
The defendant shall file an undertaking by way of affidavit in the aforesaid terms within one (1) week from today. In view of the fact that the matter has been settled at an early stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870, as applicable to Delhi.
