This writ petition is preferred on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following relief:- "a) Allow the present petition and direct respondent MCD to grant the revised sanction building plan for commercial use for address bearing no D-1A, Green Park, New Delhi to the petitioner;" 4.

Learned Standing Counsel for Respondent/MCD, at the outset, submits that this writ petition is premature as Petitioner has already acted on the communication dated 15.04.2024 and applied for revision in the layout plan on 24.05.2024 and his application is under consideration. 5.

preferred by the Petitioner for revision of the layout plan as expeditiously as possible. The decision so taken will be communicated to the Petitioner, who will be at liberty to take recourse to legal remedies, in case of any surviving grievance.

It is made clear that the objection of MCD that this writ petition is not maintainable as the order rejecting the request for building plan and/or an order disallowing erection of any building or execution of any work under Section 340 of the Delhi Municipal Corporation Act, 1957 are appealable orders, is left open.
