CRL.M.A. No.7144/2020(extension of interim bail) 1.

This order is being passed in continuation of the order dated 19.05.2020.

On 19.05.2020, this court had asked the petitioner to be examined by an appropriate medical officer/doctor to be nominated by AIIMS on 27.05.2020 at 11:00 A.M. The petitioner was to reach AIIMS accordingly on the said date.

It appears that the petitioner has not bothered to go to AIIMS on 27.05.2020. He has gone to AIIMS on 28.05.2020. It is obvious that he has tried to side step the order of this court dated 19.05.2020 to evade medical examination.

Learned counsel for the petitioner, however, reiterates that apart

from the medical conditions of the petitioner, given the fact about the continuing pandemic, it would be in the interest of justice that the petitioner is granted days interim bail.

He relies upon a communication issued by the High Powered Committee dated 18.05.2020 to submit that he may be given interim bail for 45 days. 5.

The learned APP for the State and the learned counsel appearing for the family of the deceased have strongly opposed the present application.

Mr.Prashant Mehta, learned counsel appearing for the family of the deceased has pointed out that the petitioner has in the past attempted to threaten the witnesses and has also taken other steps. He also states that false medical certificates are being filed to seek interim bail from the court.

Keeping in view the ongoing pandemic, in the interest of justice, I continue the interim bail that has been granted to the petitioner vide order dated 22.04.2020 for fifteen days, subject to the same terms and conditions as stated in the order of this court dated 22.04.2020. 8.

It is made clear that this interim bail shall be only for a period of 15 days more. Whereafter, the petitioner would not be entitled to any further accommodation.

A copy of this order be sent by the Registry by e-mail to the Jail Superintendent, Tihar for information and necessary compliance. 10.

With the above directions, the present petition and all pending applications, if any, stand disposed of.
