Mr. Abhinav Hansaria accepts notice on behalf of respondent no. 1.

Learned counsel for respondent no. 1 says that he does not wish to file a reply as he has no objection to an Arbitrator being appointed by this Court.

As a matter of fact, counsel for respondent no. 1 suggested that the Arbitrator can be appointed by the Delhi International Arbitration Centre ("DIAC").

Mr. Mitra submits likewise.

To be noted, the petitioner and the respondent no. 1 are concededly partners in respondent no. 2 firm, therefore, no formal notice needs to be issued to respondent no. 2 firm. 7.
Accordingly, the petition is disposed of with the following directions:- 7.1 The DIAC will appoint an Arbitrator in the matter. 7.2 The arbitration proceedings will be governed by the rules framed in that behalf by the DIAC.

The Registry will dispatch a copy of the order passed today to the Coordinator, DIAC.
