By way of the present petition filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioners, who are the former husband and in-laws of the complainant/respondent No.2 seek quashing of case FIR No.942/2022 dated 27.12.2022 registered under sections 498-A/406/506/34 of the Indian Penal Code, 1860 ('IPC') at The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
P.S.: Prem Nagar, Delhi based on a compromise arrived at with respondent No. 2.

In light of Practice Directions dated 24.12.2024 issued by the Hon'ble the Acting Chief Justice in relation to dealing with petitions seeking quashing of FIR based on compromise, vide order dated 11.02.2025 the learned Joint Registrar (Judicial) has verified the identity of respondent No.2; and has also recorded the statement of respondent No.2 affirming the compromise. A copy of the statement of respondent No.2 has been placed on record.

In order dated 11.02.2025, the learned Joint Registrar has recorded that respondent No.2 confirms that she has entered into a Settlement dated 10.05.2023 with the petitioners; that she has received the entire settlement amount of Rs.04 lacs from them; that she has obtained divorce from petitioner No.1 vide Divorce Decree dated 08.05.2024; that no child was born from the wed-lock; and that she has also consented to the subject FIR being quashed.

The petitioners as well as respondent No.2 have joined the proceedings via video-conferencing along with their respective counsel.

Mr. Digam Singh Dagar, learned APP submits that the State has no objection to the subject FIR being quashed based on the compromise between the parties.

In the circumstances, in line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 as also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this court sees no reason why the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
subject FIR and all proceedings emanating therefrom should not be quashed. This court is of the view that in light of the settlement between the contesting parties, continuing with the subject FIR and all subsequent proceedings would be an exercise in futility and would not be conducive to peace and harmony between the parties. 7.
Accordingly, case FIR No.942/2022 dated 27.12.2022 registered under sections 498-A/406/506/34 of the IPC at P.S.: Prem Nagar, Delhi is quashed. All proceedings arising therefrom also stand closed. 8.
The petition stands disposed-of.
