% 02.11.2016 Mr Varma, learned senior counsel appearing for the plaintiff states that the property in question has been converted from lease to free hold and, therefore, in terms of the settlement recorded on 17.05.2016, the suit is liable to be disposed of as withdrawn.
He further states that in terms of Section 16A of the Court Fees Act, 1870 introduced by the Court Fees (Delhi Amendment) Act, 2010, the plaintiff would be entitled for the refund of 50% of the Court Fees. The learned counsel for the defendant states that there would be only one Conveyance Deed for the property in which the plaintiff's share is only to the extent of 50%. She submits that the parties are endeavouring to arrive at a settlement as who would have the custody of the said document. At this stage, Mr Varma states that the plaintiff would safe keep of the deed and
hold it in trust on behalf of the defendant till the settlement is arrived at. The plaintiff is bound down by the said statement. Let a decree sheet be drawn.
The Registry is directed to issue the certificate for refund of the 50% of the Court Fees.
