This petition has been filed under Article 226 of the Constitution of India, read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking appropriate Writ in the nature of Habeas Corpus, directing respondent nos. 1 to 3 to produce Sh. Bhagwan Das Kashyap @ Nanhe Kashyap, the husband of petitioner no.1 and the father of petitioner no.2, who is stated to be missing since 28.11.2025.

The learned Standing Counsel for State has filed a Status Report dated 18th January, 2026, detailing various efforts that have been made The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. by the police, including the examination of respondent nos. 4 and 5, and also the CCTV recordings of the area concerned, to trace out the whereabouts of Sh. Bhagwan Das Kashyap @ Nanhe Kashyap 3.

The learned Standing Counsel for the State submits that in spite of best efforts, the whereabouts of the missing person could not be traced till now. He states that a formal FIR shall now be registered, and further investigation shall be carried out. 4.

Binding the respondents to the statement made above, we dispose of this petition by directing that periodical reports of further efforts made to trace out the missing person shall be filed by the respondents before the concerned Magistrate on a bi-monthly basis. Copy of the same shall also be supplied to the petitioner no.1, the wife of the missing person.
