Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') has been filed on behalf of the Petitioners for quashing of FIR No. 0407/2024 registered under Sections 115(2)/118/(1)/351(2)/351(3)/3(5) BNS at P.S. Badarpur and all the proceedings emanating therefrom in terms of the Settlement Deed dated 06.01.2025.

It is stated that the parties are neighbors and the dispute was arisen over some quarrel between the Petitioners and the Respondent No. 2. 3.

The parties are present before this Court in-person today and have been identified by their learned Counsel and the Investigating Officer. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is submitted that on the basis of Complaint filed by the Respondent No. 2, FIR No. 0407/2024 got registered under Sections registered under Sections 115(2)/118/(1)/351(2)/351(3)/ 3(5) BNS at P.S. Badarpur wherein the Petitioners were implicated. It is further submitted that there is a crossFIR bearing No.

0401/2024 registered under Sections 115/118/(1)/126(2)/3(5) BNS at P.S. Badarpur lodged by Petitioner No. 1 wherein the Respondent No. 2 and his family members were implicated. 5.

The parties have amicably resolved their dispute vide Settlement Deed dated 06.01.2025. It is prayed that the present FIR No. 0407/2024 be quashed, in terms of the Settlement.

The parties have endorsed the amicable settlement and accepted the terms thereof voluntarily. The parties have submitted that all the disputes have been amicably settled vide Settlement Deed dated 06.01.2025 and thus, no fruitful purpose will be served in continuing with the FIR. 7.

The present Petition has been signed by the Petitioners and is supported by their Affidavits. The parties have reaffirmed the terms of the settlement arrived at vide Settlement Deed dated 06.01.2025 and they also submit that the said Settlement has been arrived at between the parties, without any pressure and coercion.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is related to neighbours, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, the FIR bearing No. 0407/2024 registered under Sections 115(2)/118/(1)/351(2)/351(3)/3(5) BNS at P.S. Badarpur and all the subsequent proceedings emanating therefrom are hereby quashed qua all the accused persons.

The Petition alongwith pending Applications, if any, stands disposed of.
